Promotion: Wisconsin Sweepstakes Giveaway ("Promotion")
Jurisdiction: State of Wisconsin only

1. Promotion Period

The Promotion may be conducted as a single promotional round or, if necessary, multiple sequential promotional rounds (each, a “Round”) for a specific vehicle. The specific start and end dates for each Round will be announced by Sponsor on the official website prior to the commencement of that Round. Additional Rounds for a vehicle may be conducted at Sponsor’s sole discretion if the minimum funding threshold for that vehicle is not met during an initial Round.

2. Eligibility

The Promotion is open only to legal residents of the State of Wisconsin who are at least eighteen (18) years of age at the time of entry. Employees, officers, directors, agents, and representatives of Sponsor, its affiliates, and members of their immediate family or household are not eligible. Void where prohibited by law.

3. How to Enter

A. Paid Entry Method

  • Participants may obtain entries by purchasing entries directly from Sponsor during an active Round.

  • Each one dollar (USD $1.00) paid to Sponsor earns one (1) entry into that Round.

  • There is no limit to the number of paid entries a participant may purchase.

  • Paid entries do not represent ownership, equity, investment interest, or chance enhancement beyond the stated number of entries.

B. Free Alternate Method of Entry (AMOE)

  • No purchase is necessary to enter or win.

  • Limit one (1) free entry per person per week per Round.

  • Free entries are available through Sponsor’s official website using the same entry interface as paid entries, with a total purchase price of $0.00.

  • All free entries must include the same required participant information as paid entries.

  • Free entries have the same odds of winning per entry as paid entries.

  • Multiple free entries submitted within the same week by the same person may result in disqualification at Sponsor’s discretion.

  • Incomplete, inaccurate, automated, duplicate, or fraudulent entries are void.

4. Winner Selection

  • One (1) potential winner will be selected at random from all eligible entries received during each Round.

  • Winner selection may be assisted by automated or software-based systems; however, Sponsor retains final authority over the selection.

  • Odds of winning depend on the total number of eligible entries received.

  • Potential winners will be notified by email within five (5) business days following the drawing.

  • Failure to respond within seven (7) days of notification may result in forfeiture of the prize and selection of an alternate winner.

5. Prize Description, Fair Market Value, and Funding Threshold

A. Vehicle Prize

  • Each Round awards one (1) used motor vehicle selected by Sponsor.

  • Vehicles are awarded subject to the terms and conditions set forth herein.

B. Fair Market Value (FMV) Determination

  • Sponsor will determine the vehicle’s Fair Market Value (“FMV”) prior to the public launch of the applicable Round.

  • FMV is determined in good faith using a combination of nationally recognized vehicle valuation sources, which may include Kelley Blue Book (KBB), NADA Guides (JD Power), Edmunds True Market Value (TMV), and verified dealership pricing or invoice documentation.

  • The FMV is calculated and locked before the Round begins and will not be adjusted based on market conditions, demand, vehicle availability, or sales performance.

  • The disclosed FMV is used solely for prize disclosure, funding thresholds, tax reporting, and regulatory compliance purposes.

C. Minimum Funding Requirement

  • To award the vehicle prize, total gross funds collected from paid entries during the applicable Round must equal or exceed the vehicle’s FMV.

D. Prize Outcome Based on Funds Raised

  • If total funds raised during the Round are less than the FMV, the winner will receive a cash prize equal to fifty percent (50%) of the total gross funds collected during the Round, in lieu of the vehicle.

  • If total funds raised meet or exceed the FMV, the winner may choose either:

    • The vehicle prize; or

    • A cash prize equal to the vehicle’s disclosed FMV.

  • Any funds collected in excess of the vehicle’s FMV shall be retained solely by Sponsor as operating revenue and shall not increase the cash alternative available to the winner.

  • Sponsor’s determination of FMV, funds raised, and prize outcome is final and binding.

6. Taxes and Expenses

  • Winners are solely responsible for all federal, state, and local taxes associated with acceptance or receipt of any prize.

  • The value of the prize for tax reporting purposes shall be the disclosed Fair Market Value (FMV) of the vehicle or the actual cash prize awarded, as applicable.

  • Sponsor may require completion of IRS Form W-9 prior to prize award.

  • Sponsor may issue IRS Form 1099-MISC or equivalent tax documentation as required by law.

  • Failure to timely provide required tax documentation or eligibility verification may result in disqualification, forfeiture of the prize, and selection of an alternate winner.

  • Winners are responsible for all vehicle-related expenses, including registration, title, insurance, taxes, and ongoing maintenance.

7. Vehicle Delivery

  • Sponsor will arrange delivery of the vehicle at no cost within one hundred (100) miles of the winner’s Wisconsin residence.

  • Delivery beyond 100 miles may be arranged at the winner’s expense.

8. Vehicle Condition and Mileage Disclaimer

  • All vehicles are used and awarded “AS IS, WHERE IS.”

  • Sponsor makes no warranties, express or implied, including any warranty of merchantability or fitness for a particular purpose.

  • Vehicle mileage is measured at the start of the applicable Round and may increase prior to delivery due to transportation, testing, or maintenance.

  • Minor increases in mileage do not constitute a material change and are not grounds for prize rejection or dispute.

9. Privacy

Sponsor collects and uses participant information solely for administering the Promotion, verifying eligibility, awarding prizes, complying with legal obligations, and internal recordkeeping. Personal information will not be sold and will only be shared with service providers or authorities as required to operate the Promotion or comply with applicable law.

10. Publicity

Except where prohibited by law, acceptance of a prize constitutes the winner’s consent to Sponsor’s use of the winner’s name, city, and likeness for advertising and promotional purposes without additional compensation.

11. General Conditions

  • Sponsor’s decisions are final and binding in all matters relating to the Promotion.

  • Entries are non-transferable and have no cash value outside the Promotion.

  • Sponsor reserves the right to disqualify any participant who violates these Official Rules or engages in fraud or misconduct.

  • Sponsor may cancel, suspend, or modify any Round if events beyond Sponsor’s control compromise the integrity of the Promotion.

12. Anti-Gambling and No Lottery Acknowledgment

  • This Promotion is a sweepstakes and not gambling or a lottery.

  • No purchase is required to enter or win.

  • Paid entries do not improve the odds of winning per entry compared to free entries.

13. Limitation of Liability

To the maximum extent permitted by law, Sponsor’s total liability arising out of or relating to the Promotion shall not exceed the total amount paid by the participant, if any, during the applicable Round.

14. Governing Law and Venue

This Promotion is governed exclusively by the laws of the State of Wisconsin. All disputes shall be resolved exclusively in the state or federal courts located within the State of Wisconsin.

15. Compliance Audit and Legal Review

Sponsor conducts periodic internal compliance audits and legal reviews of its sweepstakes operations to promote adherence to applicable federal and Wisconsin laws. Such reviews do not create any additional rights for participants beyond those expressly stated herein.

16. Financial Documentation and Recordkeeping

Sponsor maintains detailed financial and transactional records for each Round, including entry totals, funding thresholds, Fair Market Value (FMV) determinations, valuation source documentation, and prize outcome calculations. Such records may be disclosed to regulatory authorities as required by law.

APPENDIX A — WINNER AFFIDAVIT & LIABILITY RELEASE (SUMMARY)

Winners may be required to affirm:

  • Wisconsin residency and age eligibility

  • Compliance with these Official Rules

  • Release of Wisconsin Auto Sweepstakes, LLC from liability

  • Acceptance of the prize “AS IS”

  • Acknowledgment that the prize constitutes taxable income based on its disclosed Fair Market Value (FMV) or cash equivalent

  • Consent to provide accurate tax documentation, including IRS Form W-9, if required

APPENDIX B — BACKEND COMPLIANCE CHECKLIST (INTERNAL USE)

Sponsor should maintain records of:

  • Round start and end dates

  • FMV determination methodology and source documentation

  • Entry logs (paid and free)

  • Weekly AMOE enforcement

  • Winner selection method and timestamp

  • Winner notification attempts

  • Tax documentation and filings

  • Vehicle title, transfer, and delivery documentation

  • Disqualification records, if any
